ProjectHut.com (“ProjectHut”) is a hosted service operated by Quasisoft Limited (“Quasisoft” or “We”). By using ProjectHut or any other services of Quasisoft, you are agreeing to be bound by the following Terms and Conditions of Use (“Terms”), as well as to the ProjectHut Privacy Policy, all of which are included by reference into these Terms.
Violation of any of the Terms below will result in the termination of Your account. While Quasisoft prohibits certain conduct and Content on the ProjectHut service, you understand and agree that Quasisoft cannot be held responsible for the Content posted on ProjectHut and you nonetheless may be exposed to such materials. You agree to use ProjectHut at your own risk.
By signing up for ProjectHut, you acknowledge that you are the owner of that account and all Content stored therein. You are wholly responsible for any and all activities that occur under the account, and for the activities and Content of other Users who have accounts under your account.
You are entirely responsible for maintaining the confidentiality of your personal details, account details and passwords. You are solely and strictly liable for any activity that occurs under Your account. You must notify Quasisoft immediately of any unauthorized uses of your account or any other security breach.
We will not disclose any of your Content uploaded to ProjectHut to anyone else without your permission, unless legally required to do so by court order, or to defend any claim or action brought against Quasisoft.
We claim no intellectual property rights over the material you provide to the Service. Your account and Content uploaded remain yours.
You are wholly responsible for your Content and all activities that occur under your account or in respect of your use of this service.ProjectHut may be used for lawful purposes only. The transmission, storage, or distribution of any information, data, or material in violation of any applicable laws or regulations is prohibited. This includes, but is not limited to: copyrighted material; trademarks; trade secrets or other intellectual property rights used without proper authorization; and/or material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.
You agree not to access or attempt to access other User’s accounts and/or Content without their express permission. Unauthorized and/or unacceptable use of ProjectHut is a violation of these Terms and may result in your account being terminated without notice, and may subject You to criminal and/or civil liability.
ProjectHut is billed and must be paid in advance on a monthly basis, and is non-refundable. Your contract will automatically renew until You cancel it.Cancellation requests must be issued via a support ticket within ProjectHut. There are no refunds or credits for partial months of service, unused months, or update/downgrade refunds.
Failure to pay an invoice by the due date may result in your account being suspended, and all access denied to your account and Content within it. Access to your account will be reactivated once all outstanding invoice(s) have been paid. An account with an invoice that is more than 30 days overdue may be terminated without notice, and all Content permanently destroyed.
The fee for first month’s invoice is waived for customers that sign up to ProjectHut for the first time, and whom have never previously held an account with ProjectHut. Customers who currently have or previously hadan account with ProjectHut are not granted a free trial period on additional or future accounts.
During the trial period, the account may be upgraded, downgraded or cancelled as requiredwithout obligation to continue service. At the end of the trial period, the second and all subsequent invoices must be paid on time to maintain ongoing access to ProjectHut.
ProjectHut reserves the right at any time to modify or discontinue, temporarily or permanently, the ProjectHut service or any part thereof, with or without notice. Quasisoft shall not be liable to Your or any Third Party for any modification, price change, suspension or discontinuance of ProjectHut.
Prices and quotas of all ProjectHut services are subject to change at any time with 30 days notice. Such notice may be provided at any time by posting the changes on the main ProjectHut website (projecthut.com), or within the ProjectHut service itself.
At its sole discretion, Quasisoft may (but is not required to) remove Content from ProjectHut that it deems: a violation of any ProjectHut policy including these Terms of Service and the Privacy Policy, harmful or objectionable, threatening, libelous,defamatory or false, subject to copyright and/or trademark laws or protection, pornographic or obscene.
We respect Your intellectual property rights, and the intellectual property rights of others. If you believe that material located on or linked to by ProjectHut violates your copyright, you are encouraged to ContactUs. We will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. Any account that is found to infringe, or repeatedly infringe, the copyrights or other intellectual property rights of Quasisoft or others may be suspended until the matter is resolved or terminated without refund.
THIS WEBSITE AND SERVICE IS PROVIDED “AS IS” AND YOU USE IT AT YOUR OWN RISK. QUASISOFT EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTY OF MERCHANTABILITY, THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE AND THE WARRANTY OF NON-INFRINGEMENT.
QUASISOFT DOES NOT WARRANT OR ENSURE CONTINUOUS, ERROR-FREE, SECURE OR VIRUS-FREE OPERATION OF THE SERVICE OR YOUR ACCOUNT. YOU UNDERSTAND AND AGREE THAT YOU SHALL NOT BE ENTITLED TO MAKE ANY CLAIM BASED ON QUASISOFT’S FAILURE, IRRESPECTIVE OF FAULT, TO PROVIDE ANY OF THE FOREGOING. YOU AGREE TO USE PROJECTHUT AT YOUR OWN DISCRECTION AND AT YOUR OWN RISK.
SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF PARTICULAR WARRANTIES, AND, TO THAT EXTENT, THE FOREGOING DISCLAIMERS MAY NOT APPLY TO YOU. TO THE EXTENT THAT YOU LIVE IN A JURISDICTION THAT REFUSES TO ENFORCE THE FOREGOING DISCLAIMERS, QUASISOFT DISCLAIMS ALL WARRANTIES, EXPRESS AND IMPLIED, TO THE EXTENT PERMITTED BY LAW.
IN NO EVENT WILL QUASISOFT BE LIABLE TO THE USER OR THIRD PARTIES FOR ANY DAMAGES, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF USE, BUSINESS INTERRUPTION, LOSS OF PROFITS OR LOSS, CORRUPTION AND/OR ALTERATION OF DATA) ARISING OUT OF OR IN ANY WAY RELATED TO YOUR DATA AND/OR YOUR USE OF THE SERVICE AND/OR YOUR ACCOUNT, WHETHER IN AN ACTION IN CONTRACT, TORT, EQUITY OR OTHERWISE.

YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE DONE TO YOUR COMPUTER OR YOUR DATA THAT RESULTS FROM SUCH ACTIVITY. IN NO EVENT WILL QUASISOFT HAVE ANY LIABILITY TO YOU OR ANY THIRD PARTY FOR UNAUTHORIZED ACCESS TO OR USE, ALTERATION, CORRUPTION, THEFT OR DESTRUCTION OF YOUR DATA AND/OR YOUR ACCOUNT.
QUASISOFT’S LIABILITY IS EXPRESSLY LIMITED FOR ANY REASON AND UPON ANY CAUSE OF ACTION TO THE AMOUNT YOU ACTUALLY PAID TO QUASISOFT FOR THE SERVICE DURING THE THREE MONTHS IMMEDIATELY PRECEDING THE DATE ON WHICH YOU CLAIM THE CAUSE OF ACTION ACCRUED.
SOME JURISDICTIONS’ LAWS PROHIBIT THE FOREGOING LIMITATION OF LIABILITY PROVISION. TO THE EXTENT THAT YOU LIVE IN A JURISDICTION THAT REFUSES TO ENFORCE THE FOREGOING PROVISION, WILDBIT’S LIABILITY IS LIMITED TO THE GREATEST EXTENT ALLOWED BY THE LAW OF THAT JURISDICTION.
You agree that Quasisoft is not liable for any unauthorised access to, or alteration of, your transmissions or data, any material or data sent or received or not sent or received, or any transactions entered into through ProjectHut.
You agree that Quasisoft is not liable for any threatening, defamatory, obscene, offensive or illegal content or conduct of any other party or any infringement of another’s rights, including intellectual property rights.
By using this website and ProjectHut services, you agree to indemnify, and hold harmless Quasisoft, its officers, directors, employees and authorised agents, from and against any and all losses, claims, damages, costs and expenses (including reasonable legal fees and costs) which Quasisoft may become obligated to pay arising or resulting from your use of ProjectHut services or the website material or your breach of these Terms and Conditions.
Quasisoft, in its sole discretion, reserves the right to suspend or terminate Your account at any time and for any reason. Your right to use ProjectHut ceases immediately upon termination.
Termination of an account, at the request of You or at Quasisoft’s discretion, will result in all data and Content being immediately deleted from ProjectHut servers, with no recourse for recovery, and you will immediately lose all data and Content related to Your account.
You are therefore solely responsible for downloading, copying or otherwise preserving the information stored in Your ProjectHut account before requesting account cancellation, or otherwise terminating Your account.
We reserve the right to update these Terms from time to time without notice. Any changes that we make will become part of these Terms when we make them, so please review these Terms periodically. Continued use of ProjectHut after any such changes shall constitute your consent to such changes. If you cannot agree to these Terms and Conditions, or to our Privacy Policy, please do not use ProjectHut.
These Terms of and Conditions of Use (including the Privacy Policy) shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. You irrevocably agree that the courts of Hong Kong Special Administrative Region shall have exclusive jurisdiction in relation to any claim or dispute concerning or arising from these Terms.
